First - I give and bequeath to my wife SOPHIA my negro woman DILILAH and her female Child FANNY also all my household and Kitchen furniture, together with all my Stock of Horses, cattle hogs and Sheep to her and her heirs forever. Item I give and bequeath to to HYDE A. DAVE my negro Child BILLY son of DELILAH to him his heirs and assigns forever. Item I give to FRED W. DEAN after the Death of my wife my negro fellow ANTHONY to him and his heirs forever. Item It is my will that my wife pay all my lawful debts due at the time of my death. It has but two witnesses, and the law requires three, and on that ground I propose two break it, ROBERT KERR was my relation and tenant he did last XXX having a wife and no children and he died last Thursday, leaving a wife and no children, and she died last Monday. HYDEN A. DAVIE who is the only one to make the wills stand good is anxious have the matter concluded, if the will can be broke and the estate disposed of as soon as possible. The widow has no relatives here she had some in North Carolina but I believe they have left the state. I want to sell the property as soon as I return from the legislature and wish you to take all the measures they can be taken in my absence. I think you must issue a XXX notifying those concerned to appear before you either concur or make their objections to the breaking of the will. I can and will appear, by attorney if one is necessary, but you know the ground on which I provided, it's to what I am to do. Write me instructions and I will follow them. The notice of the sale of the property could be published as that it might take XXX the all of January XXX and could give land and home valuation at my XXX preceeding the sale. My business urges me so at this time that I would not leave without great inconvenience as I also set out on Friday with Mr. Colombia. Yours with great respect F. These are therefore to permit and empower the said F. W. DAVIE on the 19th day inst. to exposed to public outcry the property of the said estate which may have come into his Hands to the highest bidder on a credit of 12 months for all sums above two dollars, taking bond with sufficient security for $2, and all sums under cash on delivery; fifteen days previous notice to be given by public advertisement and a return of the proceedings of the said sale to be given by him, made to the ordinaries office aforesaid, within the time prescribed by law. Whereas ROBERT KERR and SOPHENIA KERR late of state and District aforesaid, deceased, lately died intestate having whilst they lived and at the time of their death divers Goods rights and credits within the state aforesaid by means whereof the full disposition and power of granting the administration of all and singular that Goods, rights and credits of the deceased, and also auditing the accounts, calculations and reckonings of the said Administration, and a final decision of the same, to me is manifestly known to belong. I desiring that the goods rights and credits of the said deceased may well be truly administered converted indisposed of do hereby Grant to the said F. W. DAVIE, in whose fidelity in this I very much confide full power by the tenor of these presents, to administer the goods rights and credits of the said deceased which to them in their lifetime and in the time of their death did belong and to ask leave recover and receive the same and to pay the debts in which the deceased stood obliged so far forth as their goods rights credits will extend according to their rate and Order of law being first sworn on the holy evangelists of almighty God to make a true and perfect inventory thereof and to exhibit the same in the ordinaries office in Chester District in order to be recorded on or before the first Monday of March now next ensuing and to render a just and true account calculation and reckoning of the said Administration when thereunto required and I ordain, depute, and constitute you the said F. W. DAVIE administrator of all in singular the goods rights and credits of the said deceased. BRADLEY, and ROBERT ROBINSON are holden and firmly bound on to PETER WYLIE Esquire, ordinary for the District of Chester in the full and just sum of six thousand dollars lawful money of the state to be paid to the said PETER WYLIE or his successors, ordinaries of this District or there certain attorney or a signs to which payment well and truly to be made we bind ourselves and every of us our and every of our heirs executor and administrators for the whole and in the whole jointly and severally firmly by these presents. Sealed with our seals and dated the 25th day of January in the year of our Lord 1842. The condition of the above application is such that if the above bound F. W. DAVIE administrator of the goods and chattels and credits of ROBERT KERR and SOPHENIA, his wife, deceased, do make a true imperfect inventory of all in singular the goods and chattels rights and credits of the deceased which have or shall come into the hands possession or knowledge of the said F. W. DAVIE or into the hands or possession of any person or persons for him and the same so made do exhibit into the said Court of ordinary when he shall be there in two required and such goods chattels and credits do well and truly administer according to law and do make a just and true account of his acting's and doings there in when required by the said court and all the rest of the set Goods chattel and credits which shall be found remaining upon the account of the set Administration the same being first allowed by the said Court shall deliver and pay on to such persons respectively as are entitled to the Same by law and if it shall be here after appear that any last will and testament was made by the said deceased and the same be proven in court and the executor is obtain a certificate of the probate thereof and the said F. W. DAVIE do in such case if required render and deliver up the letters of administration than this obligation to avoid house to remain in full force. F. W. DAVIE and their view and appraise all in every the said goods and chattels being first duly sworn on the holy evangelist of almighty God to make it true and perfect inventory an appraisement thereof and to cause the same to be returned under your hand or any three or four of you to the said F. W. DAVIE on or before the 1st Monday of March next.
