Will, NC, Mecklenburg, James M McCullah 1841 North Carolina ] Mecklenburg County ] 16 September 1841 In the name of God Amen JAMES MCCULLAH of the county of Mecklenburg and the state of North Carolina being of sound and disposing mind and memory to make and ordained this my last will and testament in the manner and words following viz: First and principally I commend my soul to God through the grace that is in Christ Jesus and my body to the Grave to be buried at the discretion of my executors hereinafter named. ITEM 1st I will and bequeath to my wife JANE during the term of her maternal scratch natural life all my land on the east side of McMichael's Creek with the improvements they're on and as much land on the west side of said Creek as will make up two hundred acres with the above. Also my Road Wagon and team, and as much stock and farming utensils as may be necessary for her support, and also has much household and kitchen furniture and bedding as may be necessary for her comfortable living. ITEM 2nd I will and bequeath to my wife JANE my Negroes ISAAC, ELIZA and her children, BEN, AMOS, TOM and LEWIS, also ESSEX and NELSON to be for her use during the term of her natural life. ITEM 3rd I will and bequeath to my daughter NANCY H. ROSS my Negroes LUCY, MARTIN and HARRIET. ITEM 4th I will and bequeath to my son-in-law JOHN WALKER by Negroes DICE and all her children. ITEM 5th I will and bequeath to my daughter MARGARET CAROLINE POTTS my negro girl LUCINDA and six hundred dollars in cash in room of a negro Girl HANNAH intended for her in a former will. ITEM 6th I will and bequeath to my daughter ADELINE M. PARKS, EMILY and my Negroes ELIZA and her children BEN, AMOS, TOM and LEWIS, and the increase of ELIZA which last named Negroes she will get in position at the death of my wife JANE. ITEM 7th I will and bequeath to my grandchildren WILLIAM A PATTON and NANCY C PATTON two hundred and fifty dollars each. Also one hundred dollars each, the amount willed by JAMES M. LEES, deceased, to me. ITEM 8th I will and bequeath to my grandson JAMES M. WALKER my negro girl SULY and four hundred dollars in cash. ITEM 9th I will and bequeath to my three grandchildren JANE M. PARK, WILLIAM M. PARK and MARY E. PARK two hundred and fifty dollars each, also two hundred dollars each in the room of a negro woman named CHARLOTTE given to my daughter MARY ANN PARK and since dead, and my girl VENUS which girl I allow Page 1 of 3 ** PAGE BREAK ** Will, NC, Mecklenburg, James M McCullah 1841 for the use and benefit of my son-in-law JAMES PARK until his oldest child JANE M. PARK comes of age. ITEM 10 I will and bequeath to my two grandchildren JAMES M. PARK and GEORGE PARK two hundred and fifty dollars each. ITEM 11 it is my will and I direct that my son-in-law JAMES POTTS and my daughter MARGARET C. POTTS live with and take the charge of my wife JANE during her life for and in consideration of which can I give and allow them the use and benefit of the property bequeathed to my wife an item first during her lifetime. ITEM 12 I will and bequeath to my daughter MARGARET CAROLINE POTTS my negro boy NELSON at the death of my wife JANE. ITEM 13 I will and direct that at my deceased all my land not here too for devised be equally divided among my heirs at law. ITEM 14 I will and direct that all my property goods and chattels, not here in above named and disposed of be sold on a reasonable credit, and that the proceeds thereof together with all the money on hand and notes and accounts in my possession after the payment of my just debts, funeral expenses and the legacies above devised shall be equally divided among my heirs at law share and share alike. ITEM 15 I constitute and appoint my sons-in-law JOHN WALKER and JOHN M. PARK executors of this my last will and testament. ALEXANDER This code is still made this 12th day of November in the year above written to the above last will and testament in: ITEM 7 the monies devised to my grandchildren viz WILLIAM and NANCY C. PATTON I allowed to be put into the hands of a guardian for their use until they come of age and further I wish it to be confined to them and the Heirs of their body and if one should die the Survivor to inherit their device. ITEM 8 the Negro girl devised to JAMES M. WALKER as an item together with four hundred dollars confined to him and The Heirs of his body which said device I wish put in the hands of a guardian until he comes of age. ITEM 9 the division ITEM 9 I wish the money devised to JANE M. My negro girl devised to JAMES PARK as an ITEM 9 I wish the girl to remain in his possession without any encumbrance. All of the above devices I wish to be acted on as soon as my executor can make collections.
